Performance Agreement

1. Agreement

Booking agreements are negotiated by Mesquite Café Blues Band, LLC (M.C.B.B.) and the Client. By hiring M.C.B.B. for an event, you automatically consent to this agreement. 

2. Confirming the booking/Agreement

Confirmation will mean any verbal, electronic, email, text, or written acceptance of this booking/Agreement by the Client. Bookings take effect immediately upon confirmation and will be scheduled on the M.C.B.B. calendar. 

3. Payment

Payment may be made in cash, check, through PayPal, through ZELLE , or through Venmo on or before the date of the event. Make checks payable to “Mesquite Cafe Blues Band, LLC”. A tax E.I.N. / W-4 form / Invoice / can be provided if necessary. 

4. M.C.B.B. requirements

Power: The Client should ensure a safe and easily assessable source of power is provided.  M.C.B.B. can provide their own power through a power station (Battery Generator).  A  $50 charge will be added to the invoice price.  

Performance Area: The M.C.B.B. requires an area no smaller than 10’ x 10’ in order to set up their equipment and perform properly. 

Breaks: M.C.B.B. Will schedule reasonable breaks when needed. Normally, three 15 minute breaks within a three-hour period.  

Parking: The Client will ensure that parking be available for the duration of the event, and reasonable access to load and move equipment into and out of  the venue is available.  

Set-Up:  M.C.B.B. needs two-hours to set up prior to the event, and will need access to the venue at that time or sooner.

5. Performers

Exclusivity Clause: Due to the complexity of musical equipment, public address systems, and liability issues, the M.C.B.B. can not share its performance area with any other band, singer, dancer, musician, or performing artist.  Exceptions include M.C.B.B. providing a microphone for announcements, raffles, or master of ceremony activities. 

6.  Pricing 

Depending on the type of event, venue, and location, our prices may fluctuate. Typically we charge $400 flat rate for the first three hours and $100 for each additional hour of an event. We charge more if driving time is a factor, if an overnight stay is required, or an event requires an unusually hard or difficult load-in or set-up. 

We do not participate in “Pay to Play,” “Battle of the Bands,” or “Free” events. Our prices are hourly flat rate only.
